2G case: SC to hear Sunil Bharti Mittal, Ravi Ruia's pleas on April 18

The Supreme Court will on April 18 decide as to which bench will hear the pleas of Bharti Airtel's Sunil Mittal and Essar's Ravi Ruia challenging the 2G special court's order summoning them to appear before it.

The trial court had on March 19 summoned Mittal, Ruia and five others to appear before it on April 11 in connection with alleged excess spectrum allocation to the telecom companies during the BJP-led NDA regime in 2002.

While directing the listing of the matter for Thursday, the court asked both Mittal and Ruia to appear before the trial court on Tuesday and seek adjournment till April 22.

The apex court bench of Chief Justice Altamas Kabir, Justice Aniol R. Dave and Justice Vikramajit Sen deferred the hearing after Justice Sen told the chief justice that he wanted to recuse himself from the hearing of the case.

Senior counsel K.K. Venugopal, appearing for the Central Bureau of Investigation (CBI), then questioned the maintainability of the plea by Mittal and Ruia. He said the matter should go to the bench headed by Justice G.S. Singhvi, which had passed the verdict and was monitoring the investigation.

The court asked both Mittal and Ruia to furnish personal bond for their future appearance.
