Redress your grievance

While most of the grievances against insurance companies relate to claims, people have felt victimised for other reasons. If you have suffered unjustly at the hands of an insurance firm, here's how and where you can voice a complaint to find a satisfactory solution.

Approach the company
If you have a complaint against a company, the first step is to contact its customer care service.

  • Go through the statement document of your policy and highlight the exclusions that relate to your denied claim.
  • Gather all documents such as claim denial notices and billing statements before speaking to a representative.
  • Document all calls, noting down the dates and time, names of representatives and the result of your talk.
  • Ask for a date by when your claim is likely to be resolved. Call if no solution has been provided by this date.

Insurance Ombudsman
Your policy document has information about the ombudsman in whose jurisdiction the insurer's office falls.

When to approach the ombudsman

  • You can write to the ombudsman only after you have lodged a complaint with the insurer and do not receive a satisfactory reply within a month, or if the company rejects your complaint.
  • Your complaint should be filed within a year of the insurer's reply and should not be pending before a court, consumer forum or an arbitrator.

Steps to resolve the issue

  • The ombudsman will make recommendations within a month and send copies to you as well as the insurance company. If you accept the recommendations, you will have to send a letter within 15 days.
  • The ombudsman will take a decision within three months from the receipt of the complaint, which is binding on the insurance companies.
  • If you are not satisfied with the decision, you can approach other avenues, such as a court or consumer forum, for redressal.

Irda as a facilitator
The Insurance Regulatory and Development Authority takes up complaints with the insurers.

  • You can approach the grievance cell of Irda regarding cases of delay/non-response on matters relating to policies and claims.
  • You can also fill up a complaint registration form on Irda's Website, www.irdaindia.org.
